In July 2022, the Supreme Court ruled in the case of (Harpur and Brazel) that using the 12.07% calculation method to pro rata holiday entitlement is in breach of the Working Time Regulations 1998 for workers with ‘permanent’ contracts. ‘Part-year’ workers (workers who do not work all weeks of the year) are now entitled to the full statutory minimum of 5.6 weeks holiday per year. Please see the update on the REC Legal Guide before considering whether it is appropriate to use this calculator. Alternatively, you may want to use the BEIS (government) holiday pay calculator.


A permanent employee will accrue the current statutory entitlement of 5.6 weeks holiday over the full 52 weeks of the year whereas temporary workers will only accrue the 5.6 weeks over 46.4 weeks as the entitlement only accrues when they are working or employed.
