Contract 16A - Agency worker contract of employment annualised hours

This template contract is for you to use with your candidates when you want to employ an agency worker on an annualised hours basis. Please note that under this contract the agency worker will be an employee with full employment rights and will have continuity of employment between assignments.
This contract has been updated in January 2026 to reflect the introduction of joint and several liability in a supply chain involving an employment business, employed agency worker and an end-user client due to the widened definition of an umbrella company for JSL under the new ITEPA 2003 Chapter 11. This contract has also been amended to reflect the introduction of entitlement to Statutory Sick Pay from day 1 of employment and the removal of the minimum earnings requirement for eligibility under the Employment Rights Act 2025. This is due to come into force in April 2026. This has also been updated to include the Employment Rights Act 2025 (ERA 2025) amendment to the Trade Union Labour Relations (Consolidation) Act 1992 (TULRCA 1992) providing workers with the right to a statement informing them of their right to join a trade union which comes into force in October 2026.
