REC warns of possible misinterpretation in new Equalities Bill
The REC has commented on the publication of the framework of the forthcoming Equalities Bill.
Kevin Green, the REC’s Chief Executive said: “News of ‘positive discrimination’ will concern recruiters, who pride themselves on finding the best person for the job, whatever their background. However let’s be clear that it will only be possible to take this action where candidates are equally qualified for the job.
“In reality, good recruitment is about finding the right match of skills and personality for the job in hand so it is hard to envisage candidates being absolutely equal in the first place. The REC is concerned that what is a relatively minor measure could be misinterpreted and bring about illegal discriminatory practice. As employment law becomes ever more complex employers should turn to professional recruiters who can navigate these potential pitfalls.”
Commenting on the provisions on equal pay, Green continues: “Recruitment agencies are a vital part of the public sector’s supply chain; bringing in a much needed flexible resource to cover periods such as absence and leave.
“Requirements on the public sector supply chain on equal pay need further thought. It is not clear at this stage if recruitment agencies will need to demonstrate any pay gap amongst their own workforce, or whether this will also include the temporary workers they place, who could be on a different wage with every assignment they take.
"The REC will be working with the Government Equalities Office to ensure that this provision is both useful and practical.”
