REC Legal bulletin now available

The REC’s latest Legal bulletin for corporate members gives a comprehensive overview of new regulations and legal issues affecting the recruitment industry.

In the May/June edition, there is a full briefing on the implications of the Equality Act 2010 which was one of the last pieces of legislation to be passed by the former Labour Government. 

There is also a case law example, Keane vs Investigo and ors which will greatly clarify for agencies and employers, their position should they be victim of a spurious age discrimination claim. In this instance, an experienced accountant applied for a series of jobs for which she was overqualified, then lodged multiple claims against agencies alleging age discrimination.  

The Employment Appeal Tribunal dismissed the claim because it said she had not suffered detriment because she had no interest in the positions in which she applied; instead she was only interested in starting litigation against the agencies.  

The Legal bulletin also takes a look on why thoroughly checking terms of business and engagement can make a difference as to whether a member is compliant or non-compliant. 

Finally, the legal team answers some of the most frequently asked questions received via the legal helpline and there is a round-up of other issues including the increase in the National Minimum Wage due to come into force in October this year.
