HMRC to waive the penalties for non-payment of national minimum wage in respect of arrears resulting from 'sleep-in' shifts

Last month HMRC announced that they will temporarily waive the penalties for non-payment of national minimum wage in respect of arrears of national minimum wage (NMW) resulting from ‘sleep-in’ shifts which took place before 26 July 2017, and will suspend enforcement activity over such shifts in the social care sector until 2 October 2017. 

This is principally due to the fact that the ‘government recognises that written guidance published before February 2015 was potentially misleading’.
