Business Law for Recruiters

Recruitment is a risky business. It is more important than ever before that recruiters fully understand and comply with the law. Figures recently published by the Employment Tribunals Service indicate a 30% year on year rise in claims; and the Employment Agencies Standards Inspectorate now has the power to prosecute recruitment companies for breaches of the Conduct Regulations in the Crown Court meaning higher fines and harsher penalties.

REC is committed to increasing standards of compliance with regulation in the recruitment industry and providing its members with a world class service. As a key element of this REC has developed a comprehensive raft of training courses to cover the basic legislation that any well run recruitment business needs to comply with, delivered in a practical and relevant way.

We have designed three courses which may be taken either on their own or as a package of 2 or 3, depending on your particular needs.

Day One: The Basics of Running a Recruitment Business

Day Two: Employment law for staff and temps

Day Three (half day): Supplying Limited Company Contractors

Duration & Cost:

1 Day course: member rate £299

2 Day course: member rate £535 when booked and paid at the same time               

Half day course: member rate £175 special rate of £150 when booked and paid for at the same time as either or both of the full day training courses

Aims & Objectives: 

By the end of the course the individual will be able to: 

  • Understand the legal requirements of running an agency
  • Understand the different types of contracts for employing staff and engaging temps and/or contractors
  • Explain the rights of employees, temps and contractors
  • Protect your business and advise hirers
  • Understand the different types of Limited Company Contractor (LCCs) vehicles and the tax rules affecting the relationship

  • Tax (PAYE & VAT + CIS) and insurance

Overview for Day Two: Managing Staff and Temps

  • Employment status
  • Employment contracts: different types – part-time, fixed term, permanent,
    contract for services, zero hours
  • Restrictive covenants
  • Pay: NMW, holiday pay, SSP, SMP
  • Family friendly rights: Maternity, paternity & adoption
  • Working Time
  • Young workers
  • Agency Workers Directive
  • Managing staff: Disciplinary and grievance
  • Termination and dismissal: Redundancy, TUPE, unfair and constructive dismissal

Overview for Day Three (half day): Supplying Limited Company Contractors

  • Different types of limited company: Umbrellas & Managed service companies
  • IR35
  • Conduct Regulations: opt out
  • Contract terms with contractors
  • Contract terms with clients

Target Audience details:

All those involved in the recruitment process who need to ensure they are up to date with current legal requirements.

How learning & understanding will be monitored and assessed during course delivery:

Training will be undertaken within an informal atmosphere. 

Trainer support will be provided to enhance application of learning with practical exercises and discussion groups being used to allow individuals to practice their skills.

Encouraging learning application:

Delegate briefing pre course with line manager using course overview and personal development plan (PDP) as a template.

Final exercise on the programme will determine if objectives have been met and will identify intended workplace actions.  

Completion of Personal Development Plan (PDP) and personal action plan with line manager post course.
